These Terms & Conditions ("Terms") govern your use of the 1188 Towns website (the "Site"), operated by Esquire Homes ("Esquire Homes," "we," "us," or "our") to provide information about the 1188 Towns townhome development at 1188 Simcoe St S, Oshawa, ON. By using the Site, you agree to these Terms.
1. Illustrative and preliminary information
Renderings, floor plans, site plans, photographs, and descriptions on this Site are artist's impressions and preliminary concepts intended to give a general sense of the development. Actual features, finishes, dimensions, square footage, layouts, landscaping, and views may differ from what is shown. Suite counts, sizes (including the "up to 1,470 sq. ft." figure referenced on this Site), number of storeys, parking, and amenities are based on current plans and are subject to change without notice. Prices, specifications, and terms are subject to change without notice. Errors and omissions excepted (E.&O.E.)
2. Location and neighbourhood information
Distances, travel times, and points of interest shown on the Site's neighbourhood map are estimates calculated from publicly available mapping sources (including OpenStreetMap contributor data) and are provided for general orientation only. We do not guarantee the accuracy of third-party mapping data.
3. Registering your interest
Submitting the registration form does not reserve a unit, establish priority, guarantee pricing, or create any binding obligation on Esquire Homes to sell you a home. It simply adds you to our list of interested prospective purchasers so we can contact you with further information. By submitting the form, you confirm that the information you provide is accurate and that you consent to being contacted by email (and by phone, if provided) about 1188 Towns, as described in our Privacy Policy.
4. Intellectual property
The text, images, renderings, logos (including the 1188 Towns and Esquire Homes marks), and design of this Site are owned by or licensed to Esquire Homes and are protected by copyright and trademark law. You may view and share pages of this Site for personal, non-commercial purposes, but you may not reproduce, modify, or distribute this content for commercial purposes without our prior written permission.
5. Acceptable use
You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to any part of the Site, including the administrative area; submit false information through the registration form; or interfere with the Site's normal operation, including through automated scraping or spam submissions.
6. Third-party links
The Site may link to or reference third-party services (for example, social media platforms or mapping providers). We are not responsible for the content, accuracy, or privacy practices of any third-party site.
7. No warranty
The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including as to accuracy, completeness, or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.
8. Limitation of liability
To the fullest extent permitted by law, Esquire Homes will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Site, or from any reliance on information contained on it, including preliminary renderings, specifications, or neighbourhood information.
9. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.
10. Changes to these Terms
We may update these Terms from time to time as the Site or the project changes. The "Effective date" above reflects the last revision. Continued use of the Site after an update means you accept the revised Terms.
